Updated Your HIPAA Business Associate Agreements Lately?

Additional obligations imposed by the American Recovery and Reinvestment Act of 2009 on a covered entity’s business associates require HIPAA covered providers to have new business associate contracts in place by February 10, 2010. Be sure that your business associate contracts are in compliance with the new obligations—including the new Breach Notification Rule with the new HIPAA Business Associate Agreement Template from Gilliland and Markette, LLP. 

The template HIPAA business associate agreements assist ANCOR Members and other HIPAA covered providers prepare updated, compliant business associate agreements. The updated templates include requirements to ensure that your business associate contacts comply with the HIPAA’s Security and Privacy Rules—as well as the new Breach Notification Rule.  The templates are designed for use by HIPAA covered providers with their business associates—and can also be used if your organization is a business associate of another covered entity. 

Two template documents are available:

  • One template with references to sections of the HIPAA regulations involved and our comments concerning the various provisions; and,
  • A second template agreement in Microsoft Word that is adaptable to your situation.
