Litigation: Department of Justice Settles with Georgia
Today, the Department of Justice has entered a comprehensive settlement with the State of Georgia regarding its mental health and developmental disabilities delivery system. The announcement today ends investigations and a series of ADA claims brought by the DOJ since 2005. The White House announcement and comments from Attorney General Holder along with settlement agreement are in the attachment. Georgia can make no more placements in state institutions for ID/DD; they must transition all folks into HCBS settings; and they must add 750 slots by 2015 and another 400 slots to prevent institutionalization.
