DOJ Issues ADA Olmstead Guidance on Employment Service Systems

On October 31, the Department of Justice (DOJ) released a new guidance document providing states and local entities with guidelines around the ADA/Olmstead Decision and provision of employment service systems. The discussion lays out how the ADA applies to employment and day services and what states and local entities are expected to do in order to comply with the ADA and the Olmstead decision. It also lays out expectations for what should be in a city or state's Olmstead plan and what remedies are in place to make sure that those expectations are being addressed. For instance, it states "state and local government entities may assess, rebalance, and redistribute their resources to emphasize the provision of employment services in the most integrated setting appropriate."
