Federal Judge Dismisses Arkansas State Institution Suit

February 8, 2011

U.S. District Court Judge Leon Holmes dismissed a Justice Department lawsuit on Tuesday that accused the state of Arkansas of violating the Americans with Disabilities Act at its centers for the developmentally disabled, finding that the agency didn’t follow its own administrative procedures before filing suit.

The Justice Department also has filed a civil rights lawsuit over conditions at the Conway Human Development Center. Holmes has not yet ruled on that case, which wrapped up last fall after weeks of testimony.
