ANCOR is pleased to announce the release of a memorandum and and FAQ’s regarding the recent U.S. District Court for the District of Columbia rulings in the case of Home Care Association of America v. Weil. The purpose of the two documents is to update ANCOR members on the current status of the litigation that challenges key portions of the Department of Labor Home Care rule and to provide guidance on which portions of the rule are, and which are not, impacted by the recent rulings that vacate the prohibition against third-party employer use of the companionship exemption and the narrowed definition of companionship services.
ANCOR has followed the home care rule litigation closely, and has kept members up to date on breaking developments through ongoing member communications including electronic newsletters, forum updates, and conference calls. The memorandum is a comprehensive analysis of the legal issue at the heart of the case and will give providers a fuller understanding of what the impact of the rulings are, as well as put the rulings in context and summarize next steps in the legal process.
