Bazelon Releases Review of Gorsuch’s Record on Disability Cases

This week, the Bazelon Center for Mental Health Law, an advocacy organization for adults and children with mental disabilities, published a document (attached below) reviewing disability cases involving Judge Neil Gorsuch. Gorsuch has been selected by President Trump to fill the vacancy on the Supreme Court that was created when Antonin Scalia died in February 2016. (See WICs article, “Gorsuch Picked to Fill Supreme Court Vacancy,” February 6, 2017.) Bazelon’s report concludes that Gorsuch’s record indicates a “troubling” approach to the rights of people with disabilities. Particularly of concern to Bazelon are what are seen as a “narrow” view of the Americans with Disabilities Act (ADA), the Individuals with Disabilities Education Act (IDEA), and constitutional protections for people with disabilities. 

 

The review is organized by issue, and then includes a summary of cases relevant to that issue. Gorsuch’s first Senate confirmation hearing has been scheduled for March.
