State Developmental Disabilities Directors Send CMS Letter on EVV

On April 4, 2018, the National Association of State Directors of Developmental Disabilities Services (NASDDDS) sent a letter to Seema Verma, the Administrator of the Centers for Medicare and Medicaid Services (CMS) requesting additional guidance on the implementation of Electronic Visit Verification (EVV). As written in the NASDDDS letter:

“Our members face significant implementation challenges and a short timeframe for coming into compliance with EVV requirements before facing sizeable reductions to federal funding for Medicaid personal care services beginning in January 2019. These challenges are compounded by continuing uncertainty surrounding the scope of requirements. While we appreciate the guidance CMS has provided through webinars, verbal communications and sender-specific responses to questions posed through a dedicated email box, there remain sizeable questions for states with a merge eight (8) months remaining before potential penalties ensue.” Click here to see the full letter.

ANCOR has been engaged on the topic of EVV, meeting with CMS in the fall of 2017 in order to share ANCOR members’ experiences and concerns with EVV in those states that had already experimented with it. ANCOR has remained engaged since then, continuing to request guidance from CMS and arranging a meeting with leadership. We are also preparing for potential Congressional action to address the challenges arising from implementation of EVV as part of the 21st Century Cures Act.
