NASDDDS Issues Position Calling to Repeal Section 14(c)
The National Association of State Directors of Developmental Disabilities Services (NASDDDS) issued an official position calling for the repeal of Section 14(c) of the Fair Labor Standards Act (FLSA).
NASDDDS’ position statement focuses on the importance of providing fair compensation, at or over minimum wage, to individuals with disabilities along with all workers to achieve economic stability, safeguard health, and assist in future planning. Certificates issued under Section 14(c) of the FLSA authorizes employers to pay subminimum wages to workers with disabilities. NASDDDS recommends federal action and resources repeal these practices.
NASDDDS highlights recognition that “it will take dedication, focus, time, and resources to adapt our service delivery systems to move away from those structures that have relied upon subminimum wages.” In response, NASDDS recommends additional federal action and resources to develop infrastructure and capacity to increase competitive integrated employment and services necessary to maintain employment. The statement concludes with NASDDDS’ commitment to assist states through the process of successfully ending use of subminimum wages and service capacity expansion.
