Congress Races Against the Clock to Pass Omnibus Legislation

Early on Tuesday morning, Congress finalized negotiations over the fiscal year (FY) 2023 spending legislation and released the text of the bill. The nearly $1.7 trillion package combines the 12 separate appropriations bills and addresses additional health care provisions.

Key provisions relevant to ANCOR are below:

• Extending the increased FMAP for Puerto Rico through 2027.
• Extending the Money Follows the Person demonstration program through 2027.
• Unwinding the Medicaid continuous coverage requirement from the COVID-19 Public Health Emergency. The legislation will phase out the increased FMAP for states from 6.2 percentage point increase, to a 5 percentage point increase from April 1, 2023 through June 30, 2023, then to a 2.5 percentage point increase from July 1, 2023 through September 30, 2023, and then to a 1.5 percentage point increase from October 1, 2023 through December 31, 2023.

Congress must now pass the omnibus legislation before the deadline of December 23 to avoid a government shutdown. The U.S. Senate is expected to first pass the legislation, followed by the U.S. House of Representatives.
