Justice Department Sues Pennsylvania Over Housing Discrimination for People with Disabilities

The U.S. Department of Justice has filed a lawsuit against the Commonwealth of Pennsylvania, alleging that its state construction code discriminates against people with intellectual disabilities and autism by mandating costly sprinkler systems in community homes.

The code classifies these small, family-like homes as “facilities,” requiring sprinkler installation costs starting at $10,000—requirements not imposed on other single-family homes. The Justice Department argues that this violates the Fair Housing Act, as the mandate limits housing options by deterring landlords from renting to providers or people with disabilities, making apartments unfeasible and imposing financial burdens on providers.

The lawsuit seeks to allow local assessments of sprinkler needs based on residents’ specific abilities and demands monetary damages for those affected.
