DOL Announces Changes to Overtime Rule Coming in the Fall

The U.S. Department of Labor (DOL) announced that it will be proposing rulemaking to make changes to the current regulations to define and delimit the minimum wage and overtime exemptions under the Fair Labor Standards Act for executive, administrative, and professional employees. The current regulations have been in effect since 2020.  

The DOL did not provide specific information about what changes would be made, but the DOL’s fall regulatory agenda indicates that the changes will include, at minimum, raising the salary threshold for employees qualifying for overtime pay. According to the Office of Information and Regulatory Affairs, the anticipated timeline for the new proposed rule is October 2022.
