Justice Department Releases Final Rule to Enhance Web and Mobile App Accessibility for People with Disabilities

The Department of Justice (DOJ) issued a final rule under Title II of the Americans with Disabilities Act (ADA) aimed at ensuring the accessibility of web content and mobile applications (apps) for individuals with disabilities. This significant rule clarifies the obligations of state and local governments to make their websites and mobile applications accessible, thus paving the way for greater inclusivity and equal access to critical public services according to the DOJ.

The final rule underscores the Justice Department’s commitment to upholding the principles of the ADA and ensuring that no person is denied access to government services, programs, or activities due to a disability. By establishing clear and consistent accessibility standards for state and local governments’ digital content, the DOJ is working to advance the ADA’s mission of promoting equal participation in society for people with disabilities.

“This final rule marks the Justice Department’s latest effort to ensure that no person is denied access to government services, programs, or activities because of a disability,” said Attorney General Merrick B. Garland. “By issuing clear and consistent accessibility standards for state and local governments’ digital content, this rule advances the ADA’s promise of equal participation in society for people with disabilities.”

Assistant Attorney General Kristen Clarke of the Civil Rights Division hailed the rule as historic and long overdue, emphasizing its role in breaking down barriers that have hindered people with disabilities from fully participating in American life. “This rule will help ensure that people with disabilities have equal access to a full range of government services, including critical activities like voting, taking online courses, applying for public benefits, filing taxes, and more,” said Clarke.

The final rule mandates technical standards for state and local governments to ensure the accessibility of their programs and services provided through the web and mobile apps.
